Official Terms
These Terms and Conditions are the official terms for use of PreTrp. Some rights, obligations, warranties, data rights, consumer protections, employment laws, privacy laws, transportation laws, public-sector rules, school-district rules, or safety requirements cannot be waived or limited in some jurisdictions. Every limitation, release, consent, license, and disclaimer in these Terms applies only to the maximum extent permitted by applicable law.
1. Parties and Service
PreTrp is a vehicle inspection, checkpoint, ID tag scanning, badge scanning, label scanning, QR scanning, barcode scanning, manual-entry, report, notification, image, device-input, device-output, and fleet documentation software service operated by Transportation Accessories Group, together with its owners, officers, employees, contractors, affiliates, vendors, successors, and assigns, referred to in these Terms as "TAG," "we," "us," or "our." The customer organization, account administrator, driver, technician, employee, contractor, agent, inspector, user, viewer, or any person accessing the service is referred to as "you," "your," or "User."
By accessing, logging into, scanning an ID tag, scanning a badge, scanning a printed label, scanning a QR code, barcode, or other machine-readable code, manually entering a code, typing data, using a phone, tablet, computer, camera, browser, printer, upload field, download feature, export feature, dashboard, report, notification, similar feature, related feature, account provided by an employer or customer, or otherwise using PreTrp, you accept these Terms. If you use PreTrp on behalf of a company, school district, transportation provider, contractor, public entity, fleet, or other organization, you represent that you are authorized to bind that organization and its users.
2. No Safety, Legal, DOT, or Compliance Guarantee
PreTrp is a documentation and workflow tool. It is not a substitute for driver judgment, mechanic judgment, supervisory review, required inspections, preventive maintenance, accident prevention, federal or state Department of Transportation compliance, school bus compliance, workplace safety compliance, insurance requirements, manufacturer requirements, or any legal obligation.
You remain solely responsible for deciding whether a vehicle is safe to operate, whether an inspection is complete, whether a defect is reportable, whether a vehicle should be removed from service, whether repair or maintenance is required, and whether any report must be filed, retained, delivered, escalated, or acted on. We do not guarantee that any checklist, inspection ID tag, vehicle ID tag, badge, printed label, QR code, barcode, manually entered code, phone input, computer input, camera capture, uploaded image, generated image, downloaded file, printed output, report, notification, dashboard status, VIN lookup, export, PDF, email, record, similar item, related item, or other output is accurate, complete, timely, legally sufficient, admissible, retained, or accepted by any regulator, court, employer, customer, insurer, auditor, or agency.
3. Account Administration and User Responsibility
Users must be of legal age to enter into binding terms in their jurisdiction, or must be using PreTrp under the authorization, supervision, and responsibility of an employer, school district, transportation company, government entity, parent, guardian, legal representative, or other authorized organization that has the legal right to permit that use. PreTrp is not intended for unsupervised use by children or minors. Customer administrators are responsible for ensuring that every user is legally permitted, authorized, trained, and supervised to use the service.
Customer administrators are responsible for creating users, assigning roles, assigning vehicles, configuring inspection ID tags, vehicle ID tags, printed labels, badges, checkpoints, scan values, manual-entry codes, similar identifiers, related identifiers, uploading or approving images, selecting alert recipients, creating badges, training users, removing departed users, and reviewing records. Driver badge, ID tag, code, barcode, QR login, similar login, or related login may be intentionally simple for operational convenience. You are responsible for controlling badge access, ID tag access, password distribution, device access, phone and computer access, account scope, and employee use.
You agree that any activity performed through your account, badge, inspection ID tag, vehicle ID tag, username, password, scan code, manual code, phone, tablet, computer, camera, browser session, device, upload, download, print action, export action, assigned role, similar access method, or related access method may be treated as authorized activity by you or your organization. If credentials, badges, ID tags, QR codes, barcodes, manual codes, devices, computers, phones, browser sessions, passwords, similar access items, or related access items are lost, shared, stolen, photographed, copied, misused, or left available to others, you are responsible for the resulting access and records unless applicable law provides otherwise.
4. Data Collected
PreTrp may collect, generate, store, use, process, analyze, disclose, transmit, and retain data including but not limited to account information, names, usernames, passwords or reset credentials where operationally required, email addresses, phone numbers, user images, driver badge data, role and permission settings, vehicle numbers, VINs, license plates, vehicle images, vehicle notes, checkpoint names, map images, marker positions, QR values, barcode values, manual-entry values, typed inputs, selected options, phone inputs, computer inputs, camera inputs, uploaded images, uploaded files, processed images, generated thumbnails, downloaded outputs, printed outputs, inspection templates, inspection results, timestamps, odometer entries, route entries, notes, media metadata, browser/device information, IP addresses, approximate or precise location when available, scan events, login events, upload status, report status, review actions, alert routing, storage usage, server logs, troubleshooting data, similar data, related data, and other information submitted to, output from, or created by the service.
You represent that you have obtained all notices, permissions, consents, labor approvals, union approvals, employee acknowledgments, student privacy approvals, parent or guardian approvals where needed, public-sector approvals, and other authorizations required for us to receive and process the information you submit or configure.
5. Ownership, License, and Use of Data
As between you and TAG, TAG owns the PreTrp software, service design, workflows, templates, interfaces, databases, data structures, reports generated by the system, metadata, analytics, derived data, aggregated data, de-identified data, benchmarking data, operational insights, system logs, and improvements developed from use of the service. You may retain any non-waivable rights you have in original content you submit, but you grant TAG a broad license to use that content and all related data as described below.
You grant TAG a worldwide, perpetual, irrevocable, transferable, sublicensable, royalty-free license to host, store, copy, reproduce, display, perform, transmit, distribute, disclose, share, process, scan, index, analyze, modify, adapt, aggregate, de-identify, anonymize, create derivative works from, train or improve analytics and automated systems with, troubleshoot with, secure, audit, commercialize, and otherwise use all data submitted to or generated by PreTrp for any lawful business purpose, including providing the service, improving the service, developing new services, supporting customers, monitoring usage, enforcing terms, billing, storage planning, compliance, safety analysis, customer reporting, product development, research, sale or transfer of business assets, and any purpose allowed by applicable law.
You agree that TAG may use, disclose, share, transfer, sell, license, aggregate, or de-identify data to the maximum extent permitted by law. Where a specific law gives a person or organization rights that cannot be waived, those rights remain in effect only to the extent required by that law.
6. Privacy, Security, and Access
No internet service, browser-based system, QR login, barcode login, manual-entry workflow, wireless network, mobile camera workflow, phone, tablet, computer, database, backup, or hosting provider can be guaranteed secure. You acknowledge and agree that the data on or moving through PreTrp is not guaranteed to be secure, private, confidential, complete, recoverable, or protected from unauthorized access. We may use reasonable administrative, technical, and organizational measures, but we do not guarantee that data will never be accessed, viewed, lost, corrupted, disclosed, intercepted, delayed, deleted, altered, copied, exported, misdirected, misused, unavailable, or permanently unrecoverable.
Data may be accessed by TAG personnel, contractors, hosting providers, technical vendors, support vendors, legal and compliance advisors, payment providers, email providers, analytics providers, law enforcement, regulators, courts, public authorities, successors, assignees, or other third parties where we believe access is useful or necessary for support, operation, security, billing, legal compliance, business transfer, investigation, or other lawful purpose.
We may retain, archive, back up, export, delete, purge, aggregate, de-identify, or preserve data according to service settings, operational needs, billing status, storage limits, legal obligations, backup cycles, customer requests, or our business judgment. We do not guarantee that we can or will store, preserve, recover, export, restore, or provide any data. Data may be deleted, overwritten, purged, corrupted, lost, made unavailable, or removed from the system at any time with or without notice. Deleted data may remain in backups, logs, archives, derived data, cached records, exported files, emails, or aggregated datasets.
7. Photos, Media, Location, and Retention
Inspection photos and thumbnails may be compressed, resized, stripped of EXIF data, converted to WebP or JPEG, stored temporarily or permanently, transmitted to dashboards, shown in reports, included in exports, used for support, or removed according to the active plan and retention settings. Standard photo retention may be shorter than inspection log retention. Extended photo retention, bulk exports, custom reports, high-volume storage, and historical retrieval may require separate fees or may be unavailable.
PreTrp is a tool intended to assist with inspection documentation and workflow. You and your organization are solely responsible for backing up, saving, exporting, printing, downloading, preserving, archiving, retaining, and storing your own information, reports, images, records, regulatory files, compliance documents, employment records, maintenance records, and business records outside of PreTrp. You should not rely on PreTrp as your only storage location, official record repository, backup system, legal archive, or compliance archive.
Location information may be collected from browser, device, network, IP address, GPS, map, login, scan, report, or metadata sources when available. Location may be inaccurate, delayed, unavailable, or approximate. You are responsible for ensuring that location collection is lawful for your workforce, customers, passengers, students, contractors, and jurisdiction.
8. Third-Party Services
PreTrp may rely on third-party hosting, DNS, SSL, email, map, storage, analytics, payment, browser, mobile operating system, camera, barcode, QR, printer, file conversion, image processing, VIN decoding, or other services. We are not responsible for third-party availability, accuracy, privacy practices, changes, outages, fees, security incidents, limitations, or terms. VIN decoding, map data, browser camera support, QR/barcode scanning, manual-entry behavior, phone behavior, computer behavior, image upload, image processing, email delivery, download output, print output, and device behavior may vary and may fail.
9. Customer Configuration and Printed Labels
You are responsible for verifying that every vehicle, checkpoint, inspection ID tag, vehicle ID tag, QR code, barcode, manual code, printed label, badge, map marker, instruction, image, phone input, computer input, uploaded file, generated output, inspection template, report route, alert setting, similar item, and related item is correct before operational use. ID tags, badges, labels, similar items, and related items may be damaged, installed in the wrong place, copied, scanned incorrectly, typed incorrectly, weathered, covered, unreadable, replaced, or associated with the wrong record. You must inspect labels and system setup regularly.
10. Fees, Subscriptions, Storage, and Exports
Fees, plan limits, included storage, image retention, number of users, number of vehicles, support level, exports, alerts, PDF generation, custom reports, onboarding, hardware, label printing, and other features may be changed, limited, suspended, charged separately, or discontinued. Additional features, higher storage, extended retention, exports, support, setup, customization, reports, integrations, alerts, label printing, hardware, or high-volume usage may incur additional costs. Features, services, storage, reports, exports, alerts, or usage that are free, included, discounted, promotional, experimental, trial-based, or available at no charge at one time may later become paid, limited, removed, discontinued, or subject to new terms at our discretion. Failure to pay, excessive usage, suspected misuse, support burden, legal risk, or operational risk may result in reduced access, suspension, deletion, lockout, blacklisting, removal, or termination.
Data exports may be offered as CSV, ZIP, PDF, JSON, image archive, database extract, or another format at our discretion. Exports may be delayed, incomplete, limited by plan, limited by storage policy, limited by system capability, or subject to additional fees.
11. Intellectual Property, Patents, and Technology Rights
References to ID tag scanning, badge scanning, label scanning, QR codes, barcodes, manual-entry codes, camera capture, image upload, image processing, report generation, dashboards, alerts, exports, printed labels, similar features, related features, or related workflows are descriptive only. They describe the PreTrp service as provided or approved by TAG and do not grant any customer, administrator, user, vendor, or third party the right to copy, reverse engineer, reproduce, resell, patent, claim ownership over, independently commercialize, modify, or repurpose any PreTrp software, interface, database, template, workflow, report format, generated output, ID tag design, printed label design, similar design, related design, or related technology.
Your permission to access PreTrp is limited to using the service as made available by TAG and in the workflows, configurations, and operating methods allowed by TAG. You may not alter, combine, extend, integrate, automate, scrape, duplicate, bypass, re-label, repackage, white-label, resell, or use PreTrp with unapproved hardware, software, labels, scanners, printers, images, content, instructions, integrations, processes, or business methods except as expressly allowed by TAG.
TAG is not responsible for any claim, loss, dispute, infringement allegation, licensing issue, operational issue, safety issue, compliance issue, or legal issue caused by a customer, administrator, user, vendor, or other party changing the workflow, changing the labels, changing the printed output, changing the inspection process, changing the hardware or software environment, uploading unauthorized content, using unapproved images or instructions, connecting unapproved systems, bypassing permissions, exporting or repurposing outputs, or using PreTrp in a way that TAG did not approve. We may modify, disable, rename, limit, replace, or discontinue any feature, wording, workflow, output, technology, similar item, or related item if we believe a customer configuration, customer use, user change, integration, or related activity creates intellectual property, patent, licensing, operational, safety, compliance, or legal risk.
12. Prohibited Uses
You may not use PreTrp to violate law, hide vehicle defects, falsify inspections, impersonate users, bypass permissions, tamper with labels, access another customer account, overload the system, reverse engineer the service, scrape data without permission, upload unlawful or harmful content, transmit malware, interfere with security, use the service for regulated safety decisions without independent review, or rely on PreTrp as the sole means of determining legal compliance or vehicle safety.
13. Disclaimers
PreTrp is provided "as is," "as available," and with all faults. TAG disclaims all warranties, express, implied, statutory, or otherwise, including but not limited to warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, completeness, uptime, uninterrupted operation, secure operation, error-free operation, regulatory compliance, transportation compliance, inspection sufficiency, data retention, email delivery, print accuracy, QR readability, barcode readability, manual-entry accuracy, camera compatibility, mobile compatibility, computer compatibility, image upload compatibility, image processing quality, VIN decoder accuracy, report acceptance, similar functions, and related functions.
14. Limitation of Liability
To the maximum extent permitted by law, TAG will not be liable for any direct, indirect, incidental, consequential, special, exemplary, punitive, enhanced, lost-profit, lost-revenue, lost-business, lost-data, loss-of-goodwill, safety, operational, regulatory, employment, insurance, vehicle, accident, injury, property damage, downtime, inspection, maintenance, or legal damages arising out of or related to PreTrp, even if we were advised of the possibility of those damages.
To the maximum extent permitted by law, TAG's total aggregate liability for all claims relating to PreTrp will not exceed the greater of one hundred dollars ($100) or the amount actually paid to TAG for PreTrp service fees by the customer account during the three months before the event giving rise to the claim. This cap applies collectively to all claims and all theories of liability.
15. Release and Indemnification
To the maximum extent permitted by law, you release TAG from all claims, losses, liabilities, costs, expenses, damages, penalties, fines, demands, actions, and causes of action arising from or related to your use of PreTrp, your vehicles, your inspections, your reports, your ID tags, your badges, your labels, your configurations, your users, your employment practices, your data, your legal compliance, your reliance on the service, your failure to review reports, your failure to act on defects, your failure to maintain safe vehicles, similar matters, or related matters.
You agree to defend, indemnify, and hold harmless TAG from and against all claims, losses, liabilities, damages, settlements, penalties, fines, costs, and expenses, including reasonable attorneys' fees, arising from or related to your use of PreTrp, your submitted data, your users, your vehicles, your violation of these Terms, your violation of law, your lack of required consent, your account administration, your safety decisions, your inspection practices, your ID tags, badges, printed labels, third-party hardware, third-party intellectual property, your reliance on any record, alert, report, dashboard status, similar item, or related item.
16. Suspension and Termination
We may suspend, limit, disable, terminate, delete, preserve, or refuse service at any time for nonpayment, suspected misuse, security risk, legal risk, excessive support burden, abusive behavior, system risk, data risk, violation of these Terms, business reasons, operational reasons, technical reasons, account disputes, customer disputes, or any reason allowed by law. We may cancel, remove, unsubscribe, disable, lock out, blacklist, restrict, downgrade, archive, or delete any user, administrator, customer, company, account, vehicle, template, inspection ID tag, vehicle ID tag, badge, printed label, report, image, export, similar data, or related data at any time with or without notice to the maximum extent permitted by law.
Suspension, lockout, cancellation, deletion, blacklist, removal, downgrade, or termination may result in immediate loss of access to dashboards, images, reports, exports, labels, templates, historical records, notifications, uploads, downloads, account settings, and other data. We are not responsible for any loss, interruption, business impact, operational impact, inspection issue, compliance issue, employment issue, safety issue, or data loss resulting from any such action.
17. Changes to Terms
We may update these Terms at any time by posting an updated version, notifying an account administrator, changing the date, sending an email, or otherwise making the updated Terms available. We are not required to provide any specific form of notice unless required by applicable law. It is your responsibility, and the responsibility of each customer administrator and user, to periodically check these Terms, determine whether they have changed, re-read them when they have changed, and make sure continued use remains acceptable to you and your organization.
Your initial acceptance of these Terms, your creation of a user, your acknowledgment on behalf of another user, and your continued use of PreTrp means you agree that the Terms may change and that you are responsible for reviewing the current Terms. Continued access, login, scanning, manual entry, use of any feature, report submission, dashboard use, upload, download, export, or other use after an update means you accept the updated Terms to the maximum extent permitted by law.
18. Governing Law, Venue, and Interpretation
Unless a signed customer agreement, order form, invoice, or written terms accepted by TAG states otherwise, these Terms are governed by the applicable laws and venue provisions designated in the applicable customer agreement, order form, invoice, account terms, or other written terms accepted by TAG. If no specific governing law or venue is designated, governing law, venue, and jurisdiction will be determined according to applicable law and the facts of the customer relationship, TAG's business records, TAG's principal business location, and the location where the service, account, customer, dispute, or transaction is most closely connected, to the maximum extent permitted by law.
Customers and users may be located in other states, countries, provinces, territories, or jurisdictions. You remain responsible for complying with all local, state, provincial, national, international, transportation, employment, privacy, data, safety, fleet, school, public-sector, and industry-specific laws that apply to your organization, users, vehicles, data, and use of PreTrp. Nothing in these Terms is intended to remove mandatory rights or obligations that cannot legally be waived in the jurisdiction where a customer or user is located.
If any part of these Terms is found unenforceable, the remaining parts remain in effect, and the unenforceable part will be limited or modified to the minimum extent necessary to make it enforceable. Headings are for convenience only. Failure to enforce a term is not a waiver.
